Looking to build or renovate in Woods Creek?

What is the Architectural Control Committee (ACC)?
The purpose of the Woods Creek Architectural Control Committee (ACC) is to ensure that all homes, structures, improvements, and accessory or other buildings constructed in Woods Creek have quality materials and workmanship and are compatible with other homes, structures, improvements, and accessory or other buildings constructed or to be constructed within Woods Creek. Compliance with the covenants will help preserve property values and maintain the quality standards of the community.


The ACC will help you obtain covenant compliance for items including, but not limited to:

  • Construction of a deck, patio, or pergola
  • Storage Buildings
  • Pools (only in-ground pools are permitted)
  • Fence Construction 
  • Landscape Changes (especially those that affect water drainage, front and back yard)
  • New External Structures or External Remodeling (including play apparatus)
  • Placement of Satellite Dishes (in the backyard, not viewable from street)

Fence Guidelines

  • 6 ft cedar privacy fence stained a dark oak brown that matches the neighborhood, 4 by 4 posts at least 2 feet in ground. Fences along Woods Creek Road should be finished in a cap and post style. The ACC approved color of stain is Sikkens Dark Oak available at Spectrum Paints on J Street in Bentonville, Sherwin Williams sw3031 Cabin Brown, or Coffee Brown-#808410 made by Wood Defender at Fence Brokers in Lowell. A comparable color can be used with ACC approval. While you are at liberty to stain the entire fence, the ACC only requires the portion of your fence that can be seen from a road to be stained.
  • 6′ black ornamental steel fence. It should be a simple style, similar to the fence surrounding the gated common area at Woods Creek Road and Marina Drive.
  • To answer the inevitable question, you will see a variety of fences in the north end of the neighborhood. These fences have a “grandfathered” exception due to the original developer of the neighborhood not maintaining development about 10 years ago. Those fences, when replaced, will no longer have an exception and will need to submit an ACC application following the guidelines listed above.

Storage Buildings

  • siding and roofing materials to match the home
  • placement behind home and/or behind fence
  • all structures, including storage buildings, less than 200 square feet in size must be placed a minimum of seven feet from any property line, per City of Bentonville requirements
  • all structures, including storage buildings, larger than 200 square feet in size must be placed a minimum of seven feet from any property line, per City of Bentonville requirements
  • storage building dimensions along with plot plans are required to accompany any ACC application for storage building additions

A question that is often asked of the ACC is whether or not solar panels are allowed. Section III Subpart H of the Woods Creek Covenants reads: Exterior Mechanical Devises…solar devices…shall be esthetically concealed from view on all sides and shall be shielded in such a manner as to minimize noise and safety concerns. The location of such devices and the shielding to be used shall all be reviewed and approved by the ACC prior to installation


This is just a partial list of the most common situations for which you will need to contact the ACC for approval. Owners seeking to construct or modify any structure or change the exterior of a home must submit plans and specifications to the ACC for approval. Generally, changes to the interior of the home or the addition of trees and flowers do not require approval. If you are not sure if your structure or change requires approval, just ask.
